Letter of protection

A letter of protection is a written promise from a law firm to a medical provider that the provider will be paid out of the client's eventual settlement, so the client can get treatment without paying up front.

Common in personal injury because the people who need treatment most often have no insurance and no money, and providers will not see them without one.

Why it matters to the file

An LOP changes what the billing means. A provider treating under one has not been paid and has not written anything off, so the billed figure and the paid figure are the same number until settlement. That is a different picture from a case where insurance paid and adjusted, and the defense will argue about it either way.

It also means the provider has a stake in the outcome, which the other side will raise.

Where the work is

Tracking them. A firm with a hundred open files has some number of outstanding letters across some number of providers, and that number lives in somebody’s memory or a spreadsheet until it is time to settle. Reconciling them at the end is the part that delays disbursement.
