Statute of limitations
The statute of limitations is the deadline for filing a claim. Miss it and the case is usually over, and the firm has a malpractice problem.
The periods vary by state and by claim type, and the trigger date is not always the date of the incident — discovery rules, minority tolling and claims against government entities all move it.
Why tracking fails
Rarely because nobody knew the rule. Usually because the date lived in one system and the work lived in another, or because it was entered from memory during a busy intake and never verified against the file.
The reliable version reads from the matter rather than from what somebody remembered to type, and escalates on a schedule rather than on the deadline itself.
