Demand package

A demand package is the document a plaintiff firm sends an insurer to start settlement talks. It sets out who is at fault, the treatment history, the money spent, and the amount demanded, with the records attached as exhibits.

It is the first real statement of what a case is worth, and in a large share of matters it is the only document the other side reads closely before deciding whether to pay.

What is in one

  • The facts of the incident and the basis for liability
  • A treatment narrative, usually drawn from the chronology
  • Special damages, tabulated: what was billed, what was paid, what is outstanding
  • General damages, argued rather than tabulated
  • The demand itself, and a response deadline
  • Exhibits: records, bills, photographs, wage documentation

Why they take so long

Almost none of the time goes into the argument. It goes into assembly — pulling the figures out of the bills, indexing the exhibits, checking that the narrative matches the records, and discovering three days in that a wage verification never arrived.

That is the part that is mechanical, and it is the part worth automating first.
