Med-pay
Med-pay is a small amount of medical coverage on an auto policy that pays a plaintiff's early treatment bills regardless of who caused the crash, usually between $1,000 and $10,000.
It is modest and it is immediate, which is exactly what an injured person needs in the first weeks.
Why it matters more than the amount suggests
Early treatment is what prevents a gap. A client who cannot afford the first visit does not go, and the record then shows nothing for six weeks — which the defense reads as an injury that was not serious.
Med-pay covers that window. Finding it during intake, on the client’s own policy as well as any other applicable one, is worth far more than the few thousand dollars it pays.
The catch
Some med-pay carriers assert subrogation against the settlement, so it is not always free money. Whether they can depends on the state and the policy.
