Treatment gap

A treatment gap is a stretch of time when an injured plaintiff got no medical care. The defense uses it to argue the injury was minor, already better, or caused by something else.

Gaps are extremely common and usually have ordinary explanations. People lose transport, lose childcare, lose insurance, get told to rest, or simply feel better for a while and then do not.

None of that helps if the first time your side accounts for the gap is after an adjuster has raised it.

Why it is a records problem before it is an argument

A gap is in the file from the day the records arrive. Whether it costs anything depends on which side reads it first.

If it is found during workup, the response is ordinary: get the explanation from the client, document it, and address it in the demand. If it is found by the other side, the same explanation now sounds like a response to an accusation.

What counts as a gap

There is no fixed threshold. Adjusters commonly treat anything past about a month as worth raising, and past about three months as a serious argument. What matters more than the length is whether the record explains it.
